Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the websites, desktop application, mobile application, and related services (collectively, the “Services”) provided by Interview Companion, Inc. (“Interview Companion,” “we,” or “us”). By creating an account, signing in, or otherwise using the Services you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
Interview Companion is a real-time interview-assistance product. On a supported Mac the Services capture interview audio directly from the macOS system-audio output via Apple’s Core Audio Tap API (macOS 14.4 and later); on earlier macOS versions a virtual audio device you install (such as BlackHole) serves the same role. We transcribe the captured audio using a third-party speech-to-text provider and generate written answers using third-party large language model providers. Companion clients on iPhone and on the web display the streamed answers, and an optional mock-interview feature records short voice answers from you for AI coaching feedback.
We may modify, add, or remove features at any time. We will not materially reduce paid features for an active subscription period without offering a refund of unused fees on a pro-rata basis.
2. Account & Eligibility
You must be at least 16 years old to use the Services. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us at support@interviewco.ai immediately if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we believe are used by individuals under 16.
3. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Services for your own interview preparation and live use. The Services are licensed, not sold. You retain ownership of content you submit; we retain ownership of the Services, including all software, designs, and trademarks.
4. Acceptable Use
You agree not to:
- Use the Services in a manner that violates the rules, policies, or contractual terms of any third party with whom you are interviewing or being employed by, including non-disclosure and assessment-integrity policies. You are solely responsible for determining whether your use of the Services is permitted in any given context (for example, by an employer, school, or test administrator).
- Resell, sublicense, or commercially redistribute the Services or any output.
- Reverse engineer, decompile, or attempt to derive source code, except where applicable law expressly permits this and you have given us prior notice.
- Capture, transmit, or otherwise process audio, screenshots, or other content where doing so would violate applicable wiretap, recording-consent, intellectual-property, or privacy laws in your jurisdiction.
- Upload malware, attempt to gain unauthorized access to any part of the Services, scrape the Services beyond ordinary use, or interfere with other users.
- Build a competing product, or use the Services or any output as training data for a model intended to compete with us.
5. Audio, Screenshots, and Profile Content
To deliver the Services, the macOS system-audio output is captured on your Mac (via Core Audio Tap on macOS 14.4+ or, on earlier versions, a virtual audio device you install), segmented by voice activity, and transmitted to our LLM and speech-to-text providers for transcription and answer generation. Screenshots captured via the global hotkey are transmitted to the same providers for vision-based answer generation. Profile content you enter is stored locally and, when you sign in, optionally synchronized to our server so you can use it from other devices.
You represent that you have all necessary rights and consents to capture the audio, screenshots, and other content you submit, and that doing so does not violate any applicable law or third-party agreement. You are responsible for the lawfulness of your captures.
We process your captures to provide the Services, to maintain and improve them, to ensure security, and to comply with law. Mock-interview voice recordings are retained on the server only for the duration needed to generate the response and the session summary, after which the audio bytes are discarded. We do not use your captures or profile content to train our or our providers’ models without your separate, explicit opt-in.
6. AI Output Disclaimer
Answers and other output generated by the Services come from probabilistic AI models and may be wrong, incomplete, biased, or otherwise unsuitable. Output is provided “as is.” You are solely responsible for evaluating output before relying on it. The Services are not a substitute for professional, legal, medical, or financial advice.
7. Subscription, Fees, and Billing
Some features require a paid subscription. Fees, billing intervals, and the included scope are shown on the pricing page at the time you subscribe. By subscribing you authorize us and our payment processor (Stripe) to charge your payment method:
- The initial subscription fee on signup;
- The same fee at the start of each renewal period until you cancel;
- Any applicable taxes.
All fees are stated in U.S. dollars unless otherwise noted, are exclusive of taxes, and are non-refundable except as required by applicable law or expressly provided in these Terms.
8. Cancellation and Refunds
You may cancel your subscription at any time from the in-app billing portal. Cancellation takes effect at the end of the current billing period; you retain access until then and your payment method is not charged for the next period. We do not pro-rate or refund partial billing periods, except where required by law.
If we materially decrease functionality during an active billing period and you find the change unacceptable, contact support@interviewco.ai within 14 days for a pro-rata refund of the unused portion.
9. Free Tier & Beta Features
We may offer free or beta features at our discretion. These are provided “as is” without warranties or service-level commitments and may be changed or discontinued at any time. Our aggregate liability for any claims arising from free or beta features is capped at US $100.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you materially breach these Terms, if your use creates legal or security risk, or if we are required to do so by law. Upon termination the license in Section 3 ends, and we may delete your account data after a reasonable retention window. Sections 4, 5, 6, 11, 12, 13, 14, and 15 survive termination.
11. Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL INTERVIEW COMPANION, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER ARISING IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, AND (B) US $100.
13. Indemnification
You will defend, indemnify, and hold harmless Interview Companion, Inc. and its directors, officers, employees, and agents from and against any third-party claim arising from (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) your audio, screenshot, profile, or other captured content.
14. Changes to These Terms
We may update these Terms from time to time. If we make a material change we will notify you by email or through the Services at least 14 days before the change takes effect. Continued use after the effective date constitutes acceptance.
15. Governing Law and Disputes
These Terms are governed by the laws of [Delaware, USA], without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in [Delaware, USA], and the parties consent to the personal jurisdiction of those courts.
